Module 1: Understanding Affiliate Marketing Law

Affiliate marketing is when you promote a product or service and earn a commission when someone makes a purchase through your unique link or referral.

Example:

  • You share a link to a coffee maker on your blog
  • Someone clicks your link and buys it
  • You earn a $10 commission
  • The customer pays the same price (commission comes from merchant)

The Federal Trade Commission (FTC) wants to protect consumers from deceptive advertising. If you’re getting paid to promote something, consumers have a right to know.

Key Principle: Be honest and transparent about your financial relationships.


If you earn money from a recommendation, you MUST disclose it BEFORE people take action.

You must disclose when you receive:

  • ✅ Commission on sales (like Redio commissions)
  • ✅ Free products to review
  • ✅ Payment for content
  • ✅ Discounts or special perks
  • ✅ Contest prizes or bonuses
  • ✅ ANY benefit from the brand

Even $1 requires disclosure. There’s no minimum amount.

Disclosure must happen:

  • BEFORE the affiliate link
  • ✅ Every single time you promote
  • ✅ On every platform (blog, Instagram, YouTube, etc.)
  • ✅ In a way that’s impossible to miss

Wrong: “Check out this product [link]… (btw affiliate link)“
Right: “Disclosure: Affiliate link (I earn commission) → [link]“


Your disclosure must be noticeable:

  • Same font size as your other text
  • Contrasting color
  • Not hidden in walls of text

Good: Large, bold text at top of post
Bad: Tiny gray text in footer

Use clear, simple language:

  • ✅ “I earn a commission if you buy through my link”
  • ✅ “#ad” or “#affiliate”
  • ❌ “Thanks to X for partnering” (too vague)
  • ❌ “Collab with X” (unclear if paid)

Disclose where people will see it:

  • ✅ Top of blog posts
  • ✅ First 30 seconds of videos
  • ✅ Social media captions (not comments)
  • ❌ Footer only
  • ❌ Separate page only
  • ❌ After the link

Disclosure must be close to the link:

  • ✅ Right before or next to affiliate link
  • ✅ In the same view (no scrolling required)
  • ❌ Far away from link
  • ❌ In a different section

1. Vague Language

  • ❌ “Partner with X”
  • ❌ “Thanks to X for support”
  • ❌ “In collaboration with X”
  • ✅ “I earn commission if you buy through my link”

2. Hidden Disclosures

  • ❌ Tiny text
  • ❌ Light gray on white
  • ❌ Hidden in footer only
  • ❌ On separate page requiring clicks
  • ✅ Prominent, clear, at the top

3. Disclosure After the Link

❌ Wrong Order:
Buy this amazing product [link]
Oh and by the way, affiliate link!

✅ Right Order:
Disclosure: Affiliate link below
Buy this amazing product [link]

4. Relying on Platform Features Only

  • ❌ Using only Instagram’s “Paid Partnership” tag
  • ❌ Assuming hashtags alone are enough
  • ✅ Use platform features AND your own clear disclosure

5. Assuming People Know

  • ❌ “Everyone knows I’m an affiliate”
  • ❌ “I said it once in my bio”
  • ✅ Disclose every single time, on every post

Disclose at the top, then mark individual links if needed:

Product A [link] ← affiliate
Product B [link] ← NOT affiliate
Product C [link] ← affiliate

Disclose BOTH:

Full disclosure: [Brand] sent me this product for free,
AND I'm including my affiliate link (I earn commission if you buy).

Being an affiliate doesn’t mean you can’t be honest:

Disclosure: This is an affiliate link. However, my review
is honest and unbiased. I'll tell you what I really think,
good and bad.

If you don’t disclose:

  • FTC fines up to $43,792 per violation
  • Legal action against you
  • Legal action against the brand you promoted
  • Required corrective actions

Real Example: Lord & Taylor paid $11,000 for failing to disclose paid influencer posts.

  • Loss of audience trust
  • Damaged credibility
  • Removal from affiliate programs
  • Hard to rebuild reputation

Beyond legal requirements:

  • Your audience deserves honesty
  • Transparency builds long-term trust
  • Ethical marketing is sustainable marketing

Studies show: Proper disclosure doesn’t hurt conversions. Audiences appreciate honesty.


  • Am I earning money from this recommendation?
  • Is my disclosure visible BEFORE the link?
  • Did I use clear language (“I earn commission”)?
  • Is it prominent (not hidden or tiny)?
  • Is it close to the affiliate link?
  • Did I disclose on ALL platforms I’m using?
  • Would the average person understand I’m getting paid?

If you answered NO to any question, fix it before posting.


Your Responsibilities as a Redio Affiliate

When you promote products using Redio:

  1. ✅ You MUST make FTC disclosures
  2. ✅ You MUST use ethical marketing practices
  3. ✅ You MUST follow each merchant’s guidelines
  4. ✅ You are responsible for your compliance (not Redio, not the merchant)
  • Clear disclosures on every promotion
  • No fraudulent traffic (bots, click farms, etc.)
  • No false claims about products
  • No spam
  • Ethical, honest marketing

Merchants can:

  • Remove you as an affiliate
  • Withhold commissions
  • Report violations

Redio can:

  • Suspend your account
  • Remove your profile
  • Ban your wallet
